JS AUDIO VISUAL
All Equipment & Services and supplied on the following terms.
Ownership of Equipment
All equipment hired by JS AUDIO VISUAL remains the sole property of JS AUDIO VISUAL, or any company from which a sub-hire has been effected. The Hirer must not in any way dispose of the equipment by way of sale, lease, lease hire, loan or pledge the equipment by way of mortgage, security or any other means to any third party.
At the end of the hire period, the hirer must return the equipment in the same condition in which it was hired, or they shall be liable to pay JS AUDIO VISUAL the full cost of replacement of the same or equivalent new equipment.
No equipment may be taken outside of mainland England & Wales without the prior written consent of JS AUDIO VISUAL.
Return of Equipment
Equipment must be returned by the Hirer on, or before, the agreed time, unless an extension of the hire period has been requested and granted, or JS AUDIO VISUAL have agreed to collect or receive the equipment at a later time.
Late returned equipment will be subject to our Daily Hire Fee for each day or part-day until returned to JS AUDIO VISUAL, or a payment for the full replacement cost has been made. Should JS AUDIO VISUAL have to travel to any location to recover the equipment, the cost of said recovery will be chargeable at our normal rates, plus milage and shall be subject to a minimum charge of £50.00 Sterling.
Responsibility for Equipment
The Hirer will be responsible for the equipment during the hire period, for damage, loss and Third Party Claims arising out of the use of our equipment. Any loss or damage must be reported to JS AUDIO VISUAL immediately. In the case of loss or theft, the facts should also be reported to your local Police Station. Hirers are advised to ensure that they have adequate Insurance Cover for equipment, and for Third Party Claims. JS AUDIO VISUAL reserves the right to charge a deposit on any equipment hired. This deposit will be refunded once the equipment has been returned and checked for damage.
Consumables and Equipment Supplies
When consumables (e.g. Batteries, Gaffer Tape, Cable Ties, Tapes/Discs, etc) are used in connection with a hire, these will be chargeable at normal retail prices.
PAYMENT TERMS
For all account customers, payment of the full invoice value is due within 28 days of the date displayed on the invoice.
ALL cash customers are required to pay the full amount of the hire cost on commencement of the hire. Failure to do this may result in the hire being refused, and/or the deposit not being returned to the customer.
Late Payment
In the event that payment of any invoice is not received by JS AUDIO VISUAL by the due date, then JS AUDIO VISUAL may, at their discretion, collect the equipment and make charges for any letters, faxes, phone calls, travel costs and time, etc, made to attempt recovery or payment. JS AUDIO VISUAL may also place the overdue invoice with their Credit Managers, for appropriate action, whose debt recovery charges shall be added to the hire charge(s) and will therefore be payable by the hirer. A minimum charge of £10.00 Sterling may be made for any late payment(s).
Cancellation
Cancellation hire fees may, at our discretion, be charged at the following rates: -
14 - 7 days prior to commencement - 50% of quoted hire fee
7 - 3 days prior to commencement - 50% of quoted hire fee, plus 50% of quoted engineering services
Fees
Less than 48 hours before 08:00hrs of the day of commencement - 100% of all fees due, except mileage costs and unexpended consumable costs.
GENERAL
Use of Equipment for Defamatory Messages, to Incite Racial Hatred or other Prejudices, Blasphemy, Criminal Activity or Terrorist Activity
JS AUDIO VISUAL expressly forbids the use of our equipment by any person, or group of persons, who use, or are likely to use the equipment to promote any idea, which does, or might promote racial, religious, gender or sexual discrimination in either this Country, or Overseas against any individual or group of individuals. Also forbidden is the use of the equipment for blasphemous or profane language by any speaker or group of speakers using the equipment, or the promotion of, or incitement to any Criminal or Terrorist Activity.
In the event of any such use, in the opinion of JS AUDIO VISUAL, or any engineer contracted by, or working for JS AUDIO VISUAL, said person(s) reserve the right to immediately silence such a speaker, switch off, disable and remove the equipment so that no further statements of such a nature can be made using our equipment.
In the event of such silencing, disabling or removal, the Hirer, even if not personally making the statements, shall be liable for the full Hire Fees, as if the equipment had been in use for the full hire period. The decision taken by JS AUDIO VISUAL, or any engineer contracted by JS AUDIO VISUAL will be considered sufficient and final in all circumstances.
In all circumstances, unless specifically stated, the views of any person, whether spoken or displayed in a presentation, are the views of that person, and are not endorsed, or supported by JS AUDIO VISUAL.
Copyright / Performing Rights, etc.
JS AUDIO VISUAL is not responsible for the seeking or paying of any Copyright or Performing Rights for any music, play, poem or other material played or performed using any of our equipment.
Hirers and organisers of events are strongly advised to check their usage of any material with the Performing Rights Society, Mechanical Copyright Protection Society, or the relavent party relating to the copyrighted material in use, before proceeding with their event.
Other Licences
The hirer shall be responsible for the seeking and paying of any Licence as required by Local Authorities, etc for the event at which our equipment is used. This shall include the cost of any licence or inspection relating directly to the use of equipment supplied by JS AUDIO VISUAL.
Note: In respect of Licences required for 2-way radios / radio microphones, JS AUDIO VISUAL will arrange these on behalf of the Hirer, and include them as part of the hire cost.
Equipment Failure
Whilst every care is taken in the maintenance of equipment, no guarantee is given that failure will not occur. In the event of a failure, the liability of JS AUDIO VISUAL is limited to the cancellation of all or part of the hire fee according to the circumstances, at our discretion. The Hirer is responsible for informing JS AUDIO VISUAL of any problems with the equipment at the time of the problem, thus giving JS AUDIO VISUAL the opportunity to rectify the problem. Claims of equipment failure after the event will not be entertained.
No liability can be accepted for failure or injury due to misuse by the Hirer, or due to any damage to the equipment whilst on hire from what ever cause.
No liability can be accepted for any consequential loss incurred by the Hirer.
Emergency Call Out
Where a Hirer requests that JS AUDIO VISUAL attend the site due to apparent equipment failure, the Hirer will be liable to be charged for the call out, if no fault is found with the equipment.
Non - Delivery
Every reasonable effort will be made to supply equipment and services requested, however JS AUDIO VISUAL cannot be held responsible for:-
Late or non-delivery of equipment obtained from outside sources
Late arrival due to transportation breakdown, traffic and / or weather conditions
Cancellations due to industrial action, fire, flood, theft, etc.
Delays caused by late, or non-return of equipment from a previous hire.
Customer Information
It is the Hirer's responsibility to provide JS AUDIO VISUAL with their name, address and contact phone number(s) for security and accounting purposes. JS AUDIO VISUAL may also require information about the location of the event, and the nature of the event that the equipment is being used for. Failure to provide this information may result in the refusal of the hire.
Under no circumstances will JS AUDIO VISUAL be held responsible for injury caused due to misuse of equipment, including, but not limited to, the use of indoor equipment outdoors, any tampering or alterations to the equipment.
All customers hiring equipment and or services from JS AUDIO VISUAL will be asked to sign a delivery note, in doing so, they are confirming the equipment received, and are accepting the terms and conditions as listed above.
